Welcome to Cubtale! These Terms of Use (“Terms”) are a binding agreement between you (“you,” “your,” or “User”) and Cubtale Inc. (“Cubtale,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, mobile app, parenting blogs, interactive tools, games, services, communications, and any other online properties we own or operate (collectively, the “Web Properties”).

Please read these Terms carefully. By accessing or using any part of our Web Properties, you confirm that you have read, understood, and agree to be bound by them. If you do not agree, please do not use Cubtale.

1. Eligibility and Acceptance

Cubtale is designed for use by parents and caregivers. It is not intended for use by children under age of 13 without the involvement and consent of a parent or legal guardian. If you are under 18, you may only use our services with a parent or guardian’s permission. By using Cubtale, you affirm that you meet these eligibility requirements.

We reserve the right to update or change these Terms at any time. We will post the revised Terms on our website with a new effective date. Continued use after any update means you accept the new Terms.

2. Scope of Services

Cubtale offers tools and content to support parents and caregivers, including:

Baby care tracking features (feeding, sleep, growth, diapering)
Pregnancy tracking and prenatal support tools (e.g., symptoms, milestones, reminders)
Parenting blogs, tips, and editorial content
Educational tools, games, and milestone activities
Community content and comment features
Product guides and brand offers

These services may evolve over time, and we reserve the right to add, modify, or remove any feature.

3. Not Medical Advice

All content provided on Cubtale, including blog posts, tips, tools, games, and notifications, is for informational and educational purposes only. It is not intended to be used as a substitute for professional medical advice, diagnosis, or treatment. Cubtale does not provide medical diagnoses, risk assessments, or clinical decision-making tools, and no content on the platform should be relied upon emergency or medical decision-making.

Always consult a qualified health provider with any questions about your baby’s health, development, or medical condition. We do not guarantee the accuracy, effectiveness, or safety of any recommendations provided on our platform.

4. User Accounts

Some features may require creating an account. When you register, you agree to:

Provide accurate and current information
Maintain the security of your credentials
Notify us promptly of any unauthorized access
Accept full responsibility for all activity under your account

We reserve the right to suspend or terminate accounts for violations of these Terms, suspected misuse, or inactivity.

You can delete your account at any time through the app settings or by contacting us at info@cubtale.com.

5. Your Content and Submissions

Cubtale allows you to submit content, such as:

Baby logs and milestone notes
Comments on blog posts or community areas
Participation in polls, games, or surveys

By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and improve upon your submission to operate and improve our services. This license applies only to the extent necessary to operate, maintain, and improve Cubtale. Any personal or health-related information is handled strictly in accordance with our Privacy Policy and is not for advertising or shared in identifiable form.

Private information (e.g., baby health data, images) will always be treated according to our Privacy Policy and will not be shared publicly.

You are responsible for the content you submit and agree not to post anything unlawful, defamatory, harmful, or infringing on the rights of others. We reserve the right to moderate, remove, or disable access to any content that violates these Terms.

6. License and Use Restrictions

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Web Properties for personal, non-commercial purposes only.

You agree not to:

Reproduce, copy, or distribute our content or software
Reverse-engineer or interfere with our systems
Use automated tools (like bots or scrapers) to access Cubtale
Misrepresent your identity or impersonate others
Share harmful, false, or offensive content

Cubtale may provide over-the-air (OTA) updates to its mobile app and connected devices (such as Cubs) to enhance features, address bugs, or improve security. You agree to allow these updates and understand that certain functionality may require using the latest version of the software.

All rights not expressly granted are reserved by Cubtale.

7. Intellectual Property

All content on Cubtale, including our name, logo, interface, tools, illustrations, written materials, and underlying code, is the intellectual property of Cubtale or its licensors. You may not use our content or branding without our written permission.

8. Interactive Features: Games, Tools, and Blogs

Cubtale provides interactive content like games, personalized quizzes, developmental tools, and educational blog posts. These features are designed for informational use and engagement. They are not diagnostic or prescriptive tools.

We may use anonymized, aggregated, or coded data from your interactions, including pregnancy- and baby-related data, to improve features, personalize experience, and support internal research and analytics. This data cannot reasonably be used to identify you or your child. We do not use identifiable personal data to train our models. Please see our Privacy Policy for details.

9. Third-Party Services and Links

Cubtale may include links to third-party websites or services. These are provided for convenience only. We do not control or endorse any external content and are not responsible for their privacy practices, terms, or reliability.

Use of third-party services is at your own risk.

10. Privacy, Security, and Communication

We care about your privacy and security. Our Privacy Policy explains how we collect, store, and use your personal information.

We implement reasonable safeguards, but no online system is 100% secure. You use our platform at your own risk and are responsible for keeping your password and devices secure.

By using our Web Properties, you agree to receive electronic communications from us, such as emails, in-app messages, or website notices. These communications may include notices about your account, updates to our services, and other transactional or promotional messages. You agree that all such communications satisfy any legal requirement that they be in writing.

Cubtale works with select third-party service providers (“sub-processors”) to operate, analyze, and improve our platform. These sub-processors are contractually obligated to safeguard data, and their access is limited to what’s necessary to perform services on our behalf. While Cubtale uses commercially reasonable efforts to safeguard your data, including encryption, secure infrastructure, and periodic updates, we cannot guarantee that data transmitted over the internet is fully secure. You acknowledge and agree that you are responsible for maintaining the confidentiality of your account credentials, restricting access to your devices, and taking reasonable measures to protect your information. Cubtale is not liable for any loss or damage resulting from unauthorized use of your account if caused by your failure to safeguard credentials or device access.

Cubtale regularly reviews and tests the security of its systems, including through internal assessments and third-party security testing, to help identify and address potential vulnerabilities.

11. Disclaimer of Warranties

Cubtale is provided “as is” and “as available.” We make no warranties, express or implied, regarding:

Accuracy or completeness of our content
Continuous, error-free operation
Fitness for a particular purpose
Availability or uptime of services

Use of the platform is at your own discretion and risk.

12. Limitation of Liability

To the fullest extent permitted by law, Cubtale shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Web Properties, including:

Service interruptions
Inaccurate information
Content submitted by others
Data loss or unauthorized access

Our total liability for any claim shall not exceed the amount you paid us, if any, in the past 12 months.

13. Indemnification

You agree to defend, indemnify, and hold harmless Cubtale and its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney’s fees) arising from your use of the Web Properties, your violation of these Terms, or your infringement of any rights of a third party.

14. Account Termination and Deactivation

You may stop using Cubtale at any time. If you choose to delete your account, your personal data will be handled in accordance with our Privacy Policy, including deletion and limited retention of anonymized, aggregated, or coded data, where permitted by law.

We reserve the right to suspend, restrict, or permanently deactivate your access to Cubtale at our sole discretion, with or without notice. Reasons for deactivation may include, but are not limited to:

A request from you to close your account
Inactivity or failure to respond to repeated communication attempts
Relocation to or residence in a jurisdiction where use of Cubtale is restricted by law
Non-payment of any applicable fees
Misuse of the platform, including fraudulent, abusive, or inappropriate behavior
Violation of these Terms or our community guidelines
Notification of your passing

You are responsible for any charges incurred up to the time of deactivation (if applicable). We reserve the right to take appropriate action to protect our platform, users, and community integrity.

15. Global Access and Governing Law

These Terms, and any disputes arising under or in connection with them, are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. By using Cubtale, you agree that any legal claims or proceedings will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

While Cubtale is based in the United States, we welcome families and caregivers from around the world, including the United Kingdom, the European Union, Turkey, Canada, the United Arab Emirates, and more. We strive to make our Web Properties accessible and useful globally, but we do not guarantee that all features or content will be appropriate or available in every location. You are responsible for ensuring that your use of Cubtale complies with your local laws and regulations.

If you access or use our Web Properties from outside the United States, you do so at your own initiative and agree that your information may be transferred to and processed in the United States and other countries where we or our partners operate, as described in our Privacy Policy. This does not apply where local data residency requirements mandate in-country storage, such as for users located in the United Arab Emirates, where data is stored locally and transferred outside the country only where permitted or approved by the relevant authority, as described in our Privacy Policy.

Our services may be subject to U.S. export and re-export control laws and regulations. By using Cubtale, you agree to comply with all applicable laws and will not export or re-export any part of our services to embargoed countries or individuals on government-restricted lists.

16. Entire Agreement and Severability

These Terms constitute the full agreement between you and Cubtale regarding the Web Properties. If any part of these Terms is found to be invalid, the remaining sections will continue in effect. In the event of any conflict between these Terms and the Privacy Policy with respect to personal data, the Privacy Policy will control.

By accessing and using our Web Properties, you agree to the practices described here. We may update our Terms from time to time, and changes will be posted on this page. Continued use after updates means you accept the revised Terms.
